Ski Challenge Nations Cup 2024/25 / Promotional Terms and Conditions
By entering the Ski Challenge Nations Cup (“Nations Cup”) participants accept and agree to be bound by these Promotional Terms and Conditions (“Promotional Terms and Conditions”). It is therefore important for the participants to carefully read and understand these Promotional Terms and Conditions before accepting them and before participating in the Nations Cup. These Promotional Terms and Conditions constitute a legally binding agreement between the participant and the Organizer (as defined below). In addition to these Promotional Terms and Conditions, the General Terms and Conditions and the Privacy Policy of the Game apply. The Organizer reserves the right to amend these Promotional Terms and Conditions or terminate the event in the form of written amendments. 1 Organizer
1.1 The organizer of the Nations Cup is Ski Challenge GmbH, with its registered office at Wiedner Hauptstrasse 94, 1050 Vienna, registered in the commercial register of Handelsgericht Wien with company registration no.: 587965f (“Organizer”).
2 Description of the game and of the Ski Challenge Nations Cup
2.1 Developed by the Organizer, Ski Challenge is a virtual 3D simulation for iOS and Android that enables both offline and online ski racing (“Game”). In the Game, the participants race and compete on a variety of virtual ski slopes which are modelled after their real-life counterparts.
2.2 The Nations Cup is a temporary virtual event within the Game, in which players who meet the Conditions of participation specified in these Promotional Terms and Conditions (“participant” or “participants”) compete individually and in teams for prizes specified in these Promotional Terms and Conditions.
3 Conditions of participation (Eligibility criteria)
3.1 To be eligible to participate in the Nations Cup, the participants must meet the following eligibility criteria:
(i) hold citizenship status in one of the following countries: Austria, Germany, Switzerland, Italy, France, Norway and, in the case of the Europe Allstars team, in any of the following countries: Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain or Sweden;
(ii) be aged 16 or more at the time of their participation for the qualification phase;
(iii) not be an employee and/or contractor (on a freelancing basis) of the Organizer, or of the Organizer’s parent company Greentube GmbH, or of any of the companies affiliated with the Organizer;
(iv) not be involved, in any capacity, in the development and/or operation of the Game; and
(v) not be relatives of the persons specified in (iii) and (iv) above.
3.2 In addition to the eligibility criteria specified above, in order to qualify for a prize, the participants have the Game downloaded and installed, and a profile created within the Game;
3.3 Each participant may enter into the Nations Cup only once. Multiple accounts or attempts from a different account from the same participant are prohibited and may lead to disqualification of the participant, regardless of the result reached.
3.4 All participants acknowledge and agree that by qualifying for the Nations Cup, they become promoters of their respective teams. Their images, videos, and related content may be used by the Organizer for promotional and advertising purposes associated with the Game and the Nations Cup. Participants also agree to refrain from making public negative comments regarding the Game, the Organizer, or the Nations Cup.
3.5 The Organizer reserves the right to terminate the participation of any participant at its sole discretion for any reason deemed relevant by the Organizer. In such an event, the affected participant will forfeit any claims under these Promotional Terms and Conditions. The vacant place in the event will be awarded to the participant with the closest number of points to the disqualified participant.
3.6 Participants are strictly prohibited from exploiting the “carve boost“ mechanic, such as racing down the entirety or parts of a slope in a slalom or zigzagging pattern to gain an unintended speed advantage. This behavior disrupts the intended gameplay balance and violates the competition’s fairness standards. Any detection of such conduct will result in the removal of the specific performance of a player from the race leaderboard.
4 Nations Cup Duration
4.1 The Nations Cup will run from 2nd December 2024 at 00:00 CET to 2nd February 2025 at 23:59:59 CET. It will be divided into the the qualification phase (“Qualification”) and the tournament phase (“Tournament”).
Qualification
4.2 The Qualification will begin on the 2nd of December 2024 at 00:00 CET and finish on the 16th of December at 23:59:59 CET.
4.3 In the Qualification citizens of the respective countries specified in article 3.1 race against each other on specified tracks for the opportunity to represent their country in the tournament. Each participant is required to race the following tracks within the game (Beaver Creek, Zermatt, Zauchensee, Val Gardena) within the Qualification period, with no specific order necessary. The Organizer reserves the right to change the required tracks through written announcements within the Game.
4.4 Each participant is allowed a maximum of three attempts per track to achieve their best qualifying time. Only the fastest valid time (without missed gates) from these attempts will be considered for rankings on each track. In case of ties, the participants get the same number of points. In case of ties, the participants get the same number of points.
4.5 According to these results, points will be awarded to the participants. The points ranking system for the placement is specified on the Ski Challenge website, under https://ski-challenge.com/playguide-tutorial/new-scoring-system/.
4.6 Rankings are based on points. If participants have the same number of points, the tie will be broken first by the number of race wins, then by the number of second-place finishes, followed by the number of third-place finishes, and finally by the number of fourth-place finishes. If ties persist after these criteria, participants will share the same ranking.
4.7 The top 4 participants with the highest number per country (and Allstars team) advance to the Tournament phase.
Tournament
4.8 The Tournament will begin on the 27th December 2024 at 00:00 CET and finish on the 2nd February 2025 at 23:59:59 CET. The participants qualified from the previous phase will be divided in 7 national teams (each team will have 4 participants).
4.9 Teams will race each of the tracks specified below in sync with the Ski World Cup events, having a maximum of 1 attempts for each team member, for a total of 4 attempts per team, not re-assignable to other team members, for each track. The Organizer reserves the right to change the maximum number of attempts. In such case the change of attempts shall apply to all participants.
4.10 The track and the race dates are the following:

4.11 The Organizer reserves the right to change the track and race dates. In such cases the change will be accordingly communicated to the team members through relevant communication channels.
4.12 The best time (with no missed gates) will be taken into consideration to compare with the rest of the performances and define the ranking. The total points will determine the ranking, with tie-breaking criteria similar to earlier phases.
5 Winner selection and prizes
5.1 After the end of the Tournament phase, the Organizer selects three winning teams and distributes their corresponding prize. For this purpose, the Organizer assesses the time of each participation and attributes the prize to the Teams which have fulfilled all the conditions mentioned. For the Final, prizes will be the following:
(vi) The 1st place winner – 6000 EUR divided in equal parts between the team members, including substitute participants.
(vii) The 2nd place winner – 3600 EUR divided in equal parts between the team members, including substitute participants.
(viii) The 3rd place winner – 2400 EUR divided in equal parts between the team members, including substitute participants.
5.2 In addition, the Organizer may decide to include a physical medal as part of the prizes.
5.3 There is no legal claim to the prizes. The winner is not entitled to request the exchange of the prize for any monetary or non-monetary compensation. The Organizer reserves the right to exchange the prizes for monetary or non-monetary compensation of a similar value.
5.4 The winner is not entitled to transfer the prize to a third party. All taxes and customs, if any, levied on the prize or its delivery to the winner shall be borne by the winner. The Organizer shall not reimburse the participants for any costs incurred by them in connection with their participation in the Nations Cup, or with a win in the Nations Cup. The Organizer bears no responsibility for defects in the prize and possible damages in connection with the use of the Prize.
6 Prize acceptance and communication
6.1 After confirming that the participants meet the Conditions of participation and Winner selection above, the Organizer will contact the winners via email and verify their identity, their age and citizenship requirements. For the Qualification, winner’s eligibility, proof of citizenship will be requested (through e.g. Valid passport or national ID, or driver’s license). If conditions are not fulfilled, the prize may be only awarded based on the Organizer’s discretion.
6.2 Should the winner accept the prize, provide all necessary information requested by the Organizer, and meet the relevant requirements within the 72-hour period from the initial email communication, the prize will be awarded to the winner either in person, by registered post or email or via in-game actions.
6.3 If the winner does not meet the requirements, declines the prize or the in-person meeting, and/or does not provide the Organizer with the required information within the 72-hour period from the initial email communication, the Organizer can decide whether it will select a substitute winner following the same procedure as above or whether the prize will be considered vacant and will not be passed on any other participants.
6.4 Participants from the winning teams may be required to appear in person on an event of the Organizer’s choosing in Switzerland to receive their prizes. The Organizer will cover accommodation costs for this purpose. The Organizer reserves the right to select the relevant accommodation. Travel costs are not covered by the Organizer. Participants who refuse to appear in person may forfeit their winnings at the Organizer’s discretion.
6.5 By entering in the Nations Cup and accepting these Promotional Terms and Conditions, the participants understand and expressly consent that their images, videos or names may be used for the purposes of promoting Organizer’s products and services, including, but not limited to publication the winners in newsletters, websites, social networking sites and other digital communications channels. Such use shall be without an obligation for the Organizer to pay any form of compensation, including royalties arising from the photographs/videos/other visual content to winner’s benefit, and by accepting these Promotional Terms and Conditions the winners grant all exclusive rights for using such material including intellectual property right/copyright to the Organizer.
7 Publication of the winners
7.1 Winners may be published (within the scope of their personal data as specified in article 8 below) on the website and social media platforms of the Organizer or third parties who have been commissioned by the Organizer to publish the winners.
8 Data protection
8.1 To achieve the aims of the Nations Cup and subsequent reward of its participants, the Organizer (data controller) collects and processes personal data of the participants. The Organizer conducts these processing activities always pursuant and within the scope of the Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and the Austrian Data Protection Act (Datenschutzgesetz).
8.2 The purpose of the processing is the: (i) provision of our services in regard to tournaments i.e. enabling participation in the Nations Cup according to participants’ request and (ii) administration of the promotion for the Nations Cup. The scope of the personal data is limited to the strictly necessary data and constitutes, primarily: first name, surname, username on the relevant social media platform, participants alias, email address, performance data from the Game and unique participant ID. For the winners, additional personal data, such as a copy of the valid ID and delivery address may be processed. In addition, photo and video may be requested. Legal basis for the processing is performance of a contract with the data subjects and when applicable, legitimate interest for fulfilling the purposes as explained above.
8.3 The participants understand that by participating in the Nations Cup their personal data within the scope of participant alias and performance data may be shared on the social media and websites of the Organizer or third parties who have been commissioned by the Organizer to publish the participants. The participants understand that by winning the Nations Cup their personal data within the scope of first name, last name, participant alias and performance data from the Game may be shared on the social media and websites of the Organizer or third parties who have been commissioned by the Organizer to publish the winners.
8.4 The Organizer may, at their discretion, request interviews with participants for promotional, marketing, or informational purposes related to the Nations Cup. Participation in such interviews is entirely voluntary. Participants may choose whether or not to partake in any requested interviews, and their decision will not affect their standing in the competition or eligibility for prizes. If a participant agrees to an interview, they consent to the use of their name, image, and voice in connection with promotional materials created by the Organizer.
8.5 Some of the personal data above (winner’s name, surname, residency address) may need to be communicated to a third-party (including but not limited to issuer of the prize, the relevant courier service or respective government authorities, if deemed necessary) in order to facilitate the issuance and delivery of the prizes or fulfil legal obligations.
8.6 Organizer will only use the personal data supplied to enable the participants to take place in the Nations Cup and for the administration of the promotion for the Nations Cup and for no other purpose. Participant’s personal data will at all times be kept confidential.
8.7 Participant can request access to their personal data, or have any inaccuracies rectified, or request deletion of data, objection or portability (in certain circumstances) by sending an email to: info@skichallenge.com. By participating in the Nations Cup, the participant agrees to the use of their personal data as described here. Participants can withdraw from the Nations Cup at any time. Organizer will retain participants’ personal data for as long as necessary to fulfill the purposes mentioned above and as described in the Organizer’s Privacy Notice.
8.8 Further details relating to the Organizer’s data processing, storage and the associated data subjects’ rights are entailed in Organizer’s Privacy Notice.
9 Final provisions
9.1 The Nations Cup is in no way sponsored, endorsed, or administered by, or associated with any social media platform. By entering the Nations Cup, the participant agrees to these Promotional Terms and Conditions and confirms that they release social media platforms of any responsibility in connection with this Nations Cup.
9.2 The Organizer reserves the right to decide on all questions related to this Nations Cup as well as reserves the right to limit, postpone, interrupt, change or cancel the Nations Cup at any time for reasons worthy of special consideration.
9.3 All intellectual property rights, including but not limited to copyrights, trademarks, and any other proprietary rights, arising from any materials, content, or creations developed during or in connection with the Nations Cup, including but not limited to graphics, videos/photos, promotional materials, and any other content created with the assistance of participants’ personal data, shall remain the exclusive property of the Organizer. By participating in the Nations Cup, participants acknowledge and agree that:
(ix) Any content, materials, or creations that incorporate or are derived from the Game, the competition, or the Organizer’s branding are the sole intellectual property of the Organizer, regardless of the participant’s contribution;
(x) The Organizer retains the right to use, modify, reproduce, and distribute any such intellectual property for promotional, marketing, and other purposes without further compensation or consent from the participants;
(xi) Participants hereby waive any moral rights they may have in relation to the content created during the Nations Cup and agree not to challenge the ownership of the Organizer regarding any such intellectual property.
9.4 The Organizer reserves the right to verify all participants and/or winners and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the Game and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Promotional Terms and Conditions or of the General Terms and Conditions, or otherwise where a participant has gained unfair advantage in participating in the Nations Cup or won using fraudulent means. This includes, but is not limited to:
( ) Manipulation of results, providing incorrect or misleading data, or engaging in unsportsmanlike conduct;
( ) Use of unauthorized third-party software, bots, or other tools that automate or interfere with normal gameplay;
(i) Exploitation of bugs or malfunctions in the Game to achieve an unfair advantage;
(ii) Collusion between participants to manipulate rankings or outcomes.
9.5 Additionally, where a participant is prohibited by law from receiving any form of winnings or compensation or is disqualified for any reason under anti-money laundering (AML) regulations or other legal requirements, the Organizer reserves the right to refuse to provide the prize or compensation.
9.6 Participants must not disclose or reveal the results of any race prior to their official publication by the Ski Challenge. Any breach of this obligation may lead to disqualification from the Nations Cup and revocation of any awards or recognitions.
9.7 In addition, the Organizer is entitled to exclude any participant from the Nations Cup who has provided incorrect data or information in the Nations Cup, manipulated or attempted to manipulate the results of the Nations Cup and its individual phases, deliberately caused or exploited a Game malfunction or defect.
9.8 In the event of any dispute regarding the Nations Cup, the decision of the Organizer will be final and binding.
9.9 By entering into the Nations Cup, the participants agree to be bound by these Promotional Terms and Conditions.
9.10 Participants must ensure that their participation (including the acceptance of any prize awarded) is lawful in accordance with the laws of the country of which they are a citizen and/or reside. The Nations Cup may be void where void under local national laws. The Organizer makes no representations, express or implied, as to the legality of any individual’s participation.
9.11 If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Promotional Terms and Conditions and the remaining clauses shall be unaffected and remain in full force and effect.
9.12 These Promotional Terms and Conditions shall be governed by and construed in accordance with the laws of Austria. Any disputes arising in connection with these Promotional Terms and Conditions shall be subject to the exclusive jurisdiction of the Austrian courts.
9.13 These Promotional Terms and Conditions are construed in English and German language. In case of discrepancies between the two language versions, the English version shall prevail.
